Important! The Next Step in the Independence Water Suit

Hi Everyone,

Attached is FCC II’s and West Elbert County Well Users Association’s (“West Elbert”) latest joint filing in our fight against Independence to try to stop their request in the water court for the expansion of their use of the Upper Dawson.  It is a Reply Motion to Independence’s latest filing.

Here’s where we are with the latest court filings right now:

  1. As you are aware, the FCC II and West Elbert jointly filed a Summary Judgment Motion on September 26, 2022.  You all received a copy of that Motion with a Newsletter explaining the purpose of that filing on October 1, 2022.  It’s also on our SaveFranktown website.

  1. Then Independence filed a Response to that Summary Judgment Motion.
