Just a quick update on the Independence “water grab” trial. I want all of you to be aware of everything as this fight progresses.
The next status conference in this case is scheduled for February 17th. It will be over the phone with the judge and attorneys like the last one. As I indicated in my last emails, I expect that Independence will ask the court to order that all parties who did not file the required disclosures and decree comments be removed from the case. At this point it looks like about 36 did file, which, obviously, includes us. The court may also set deadlines for Independence to file responses to opposers’ comments and/or a revised proposed decree and engineering, although it seems like the parties’ positions are pretty set at this point so we’ll see on this.
The discovery period for the trial in 2023 has commenced so the FCC II attorney will prepare and file discovery requests.
