Court Order! Oral Argument Set In Independence Water Grab Lawsuit!

Hi Everyone,
Surprisingly enough, we were able to get on the Colorado Supreme Court’s current session.
ATTORNEY’S ORAL ARGUMENTS IN THE INDEPENDENCE WATER GRAB CASE IS NOW SET FOR: Wednesday, January 17, 2024 at 1:00 p.m., in Supreme Court Courtroom at 1:00 p.m., 2 East 14th Avenue, Fourth Floor, Denver.
Hopefully, it’s helpful to have argument just a few months after the appellate briefs were filed this November.  I have included in this Newsletter my Newsletter from November 15th to you so you have the FCC II’s and the WECWUA’s responsive appellate briefs that will be argued on January 17th.
It is so important for as many of you as possible to attend so the court knows just how important our water is to all of us.  Please put January 17th on your calendars.

NOVEMBER 15, 2023 NEWSLETTER:
Hello Everyone,
ATTACHED IS THE FCC II’S AND THE WECWUA’S REPLY BRIEF TO INDEPENDENCE’S RESPONSE TO OUR APPEAL.  ALSO, ATTACHED IS A REQUEST FOR ORAL ARGUMENT BY OUR ATTORNEY.  This is the last stage in this case which we have been fighting for quite a while.
All of the communities impacted have been GREAT in staying involved and supporting this important, lengthy effort!!
A VERY SIGNIFICANT ASPECT OF THE LAWSUIT AT THIS STAGE OF THE PROCEEDINGS IS OUR REQUEST FOR ORAL ARGUMENT.   WE ALL NEED TO ATTEND WHEN THE DATE FOR ORAL ARGUMENT IS SET!!!   USUALLY ORAL ARGUMENT, IF GRANTED, IS SCHEDULED ABOUT 6 -8 MONTHS AFTER THE REQUEST IS FILED.  WE NEED TO SHOW UP TO LET THE JUDGE KNOW HOW IMPORTANT THIS CASE IS TO ALL OF US IMPACTED BY WHAT INDEPENDENCE IS TRYING TO DO TO THE UPPER DAWSON.  AS SOON AS I KNOW THAT DATE, I WILL SEND IT TO ALL OF YOU.  WE NEED TO GET THIS INFORMATION OUT FAR AND WIDE!
